1. ACCEPTANCE OF TERMS

By accessing or using Kinetix ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Age Requirements (by jurisdiction):

  • EU/UK: 16 years old (or age of digital consent in your country)
  • USA/Canada/Australia: 13 years old
  • South Korea: 14 years old

2. AI-GENERATED CONTENT DISCLAIMER

Kinetix uses AI models (including but not limited to Kling, Veo 3, Flux, Nano Banana, and ElevenLabs) to generate videos, images, scripts, and voiceovers.

2.1. Probabilistic Nature: AI models are probabilistic and may produce inaccurate, repetitive, or offensive content. We do not guarantee the uniqueness or factual accuracy of generated assets.

2.2. No Professional Advice: The Service is for entertainment and creative purposes only. It should not be relied upon for legal, medical, or financial advice.

3. INTELLECTUAL PROPERTY RIGHTS

3.1. Your Inputs: You retain ownership of the text prompts and images you upload to the Service.

3.2. Your Outputs: Subject to your compliance with these Terms and full payment of applicable fees, we assign to you all commercial rights, title, and interest in the specific videos and images generated by you using the Service.

3.3. Platform Use: You grant us a perpetual, non-exclusive, royalty-free license to use your Inputs and Outputs to operate the Service, improve our AI models, and for marketing purposes (e.g., a "Showcase" gallery), unless you opt-out via account settings.

4. USER REPRESENTATIONS & PROHIBITED CONTENT

You agree not to use the Service to generate:

4.1. NSFW/Adult Content: Nudity, pornography, or sexually explicit material.

4.2. Deepfakes/Impersonation: Content that mimics real persons (especially public figures) without their consent, or is intended to deceive/mislead.

4.3. Hate Speech: Content promoting violence, discrimination, or harassment.

Violation of this clause will result in immediate account termination without refund.

5. SUBSCRIPTIONS, CREDITS & PAYMENTS

5.1. Payment Processing: Payments are processed securely via Stripe. All transactions are encrypted and handled according to PCI-DSS standards.

5.2. Credit System: The Service operates on a monthly credit allocation. Unused credits do not rollover to the next month unless explicitly stated in your plan.

5.3. Refund Policy: Due to the high cost of GPU processing, we do not offer refunds for credits that have already been used. If you have not used any credits, you may request a refund within 7 days of purchase.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Kinetix shall not be liable for any indirect, consequential, or incidental damages. Our total liability to you shall not exceed the amount you paid us in the 6 months preceding the event giving rise to the claim.

7. GOVERNING LAW

These Terms are governed by the laws of Romania and the European Union. Any disputes shall be resolved in the competent courts of Bucharest, Romania.
